Welcome to BiteBase. These Terms and Conditions (“Terms”) govern your use of our website and mobile application (collectively referred to as the “Platform”). By accessing, browsing, registering, or ordering from BiteBase, you agree to be legally bound by the following Terms and Conditions. Please read them carefully.
1. Definitions
“BiteBase”, “we”, “our”, or “us” refers to the company providing the online food delivery service.
“User” or “you” means any individual or entity accessing or using the Platform.
“Vendor” or “Restaurant Partner” means the third-party food providers listed on our platform.
“Order” means a food or beverage purchase placed through the Platform.
2. Use of the Platform
You must be at least 18 years of age to register or place an order on BiteBase. By doing so, you confirm that you meet this requirement.
You agree to use the Platform only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else’s use of the Platform.
3. Account Registration
You are required to create an account to place orders, track deliveries, and access certain features.
All information provided must be accurate, current, and complete.
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
4. Ordering and Delivery
Orders can only be placed through the BiteBase Platform.
Once an order is placed, you will receive an order confirmation. This does not mean the order has been accepted. It is subject to restaurant confirmation and availability.
BiteBase reserves the right to cancel an order if the item is unavailable or if the restaurant partner declines the order.
Delivery times are estimates and may vary due to traffic, weather, or restaurant preparation time. We are not liable for delays beyond our control.
5. Payment
We accept M-Pesa, debit/credit cards, and other payment methods available on the Platform.
Payment is processed securely through third-party payment providers.
Orders must be paid in full before delivery unless “Cash on Delivery” is selected, where available.
6. Cancellation and Refunds
Orders can be canceled within a limited time after placing them—before the restaurant starts preparing the food.
If you need to cancel or modify an order, please contact our support team immediately.
Refunds will be issued under the following conditions:
The restaurant fails to deliver the food
Incorrect or significantly delayed orders
Duplicate payments due to system errors
Refunds are processed within 7–14 business days depending on your payment method.
7. Restaurant and Food Liability
BiteBase acts as an intermediary and does not prepare or package food.
Responsibility for food quality, hygiene, ingredients, allergens, and pricing rests solely with the restaurant partner.
Users are encouraged to read menu descriptions carefully and contact support for allergen concerns before placing orders.
8. User Conduct
You agree NOT to:
Use false or misleading information
Abuse promotional offers
Harass, threaten, or defame our staff, riders, or partners
Use automated systems (e.g., bots) to interact with the Platform
Violate any local, national, or international laws
BiteBase reserves the right to suspend or terminate user accounts that breach these conditions.
9. Promotions & Discount Codes
Promo codes and special offers may be issued by BiteBase and are subject to expiration and specific terms.
BiteBase reserves the right to cancel any promotion or withhold benefits if fraudulent use is detected.
10. Limitation of Liability
To the maximum extent permitted by law, BiteBase shall not be liable for:
Indirect or consequential losses
Delays or delivery failures due to force majeure
Loss of data, revenue, or profits
Food-related injuries or allergic reactions
Our total liability under these Terms shall not exceed the value of the order in question.
11. Intellectual Property
All content on the Platform, including logos, text, graphics, icons, and software, is owned by or licensed to BiteBase and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our written consent.
12. Privacy and Data Protection
We respect your privacy. Your personal information is collected and processed according to our Privacy Policy. By using the Platform, you consent to the collection and use of your data as described therein.
13. Third-Party Links
The Platform may contain links to third-party websites or services that are not owned or controlled by BiteBase. We are not responsible for their content, privacy policies, or practices.
14. Changes to Terms
BiteBase reserves the right to modify these Terms at any time. Any changes will be posted on this page, and your continued use of the Platform constitutes acceptance of the revised Terms.
15. Governing Law
These Terms and your use of the Platform are governed by the laws of the Republic of Kenya. Any disputes shall be resolved in Kenyan courts.
